Introduction

In this privacy policy (the “Privacy Policy”), we describe the information, including personal information and special or sensitive personal information, that Air Partner LLC1 ("us," "our," "we" or “Air Partner”) collects or gathers, uses, or discloses in connection with the services it provides to the White House Travel Office and members of the White House Press Corps.

The purpose of this site is for members of the White House Press Corps and others to register to travel on trips that are arranged and managed by the White House Travel Office (“WHTO”).

Unless stated otherwise, this Privacy Policy only applies to information that we collect through the website www.presscorpstravel.com (the “Site”) when you use the services that are made available through the Site. This Privacy Policy also applies when you contact or interact with us offline, such as sending us an email. In this Privacy Policy, the services made available on the Site and services that are provided to you when you contact us offline are referred to collectively as the “Services.”

Please note that our use of your information is be governed by additional terms, including the White House Press Corps Travel Policies and Procedures and the Site’s Terms of Use. If there is a conflict between that agreement and this Privacy Policy pertaining to your personal information, this Privacy Policy will govern with regard to that particular conflict.

Only Authorized Users are permitted to use the Site and our Services. We are not responsible for determining who is an Authorized User. To become an Authorized User, you must follow the Site’s registration instructions.

When you use the Services, your use will be subject to this Privacy Policy, which is incorporated into and forms a part of the Site’s Terms of Service. Where permitted by applicable law, any disputes regarding our use, disclosure, or other processing of your information, including your personal information and special or sensitive personal information, will be subject to the dispute resolution provisions set forth in the Site’s Terms of Service.

This Privacy Policy may change from time to time. If we make material changes to the manner in which we use, disclose or otherwise process your information, we will endeavor to notify you by noting on the Site that the Privacy Policy is new, or by emailing you at the last known email address on record (if you have registered with us).

1. Information We Collect About You and How We Collect It

We collect information directly from you.

We collect information about you, including personal information – and in some cases sensitive or special personal information directly from you, from other persons or entities (such as your employer), and automatically as you use the Site or Services. The scope of information, including personal information, that we collect from you varies based on your interaction with the Site or Services. We collect information from you as follows:

  • 1.1. Account Creation or Update:

    When you register and create an account, we collect the following mandatory information: gender, legal first name, legal middle name, legal last name, date of birth, birth city, birth date or province, birth country, job title, work phone (optional), mobile phone, citizenship, special food requirements (optional), employer/company name (or indication that user is a freelancer), passport(s) number(s), passport issue date(s), passport expiration date(s), passport issuing authority(ies), passport location(s) issued, an image of your passport, and an indication of your preferred form of payment (ACH/wire transfer or credit card). NOTE: The Site does not collect or process credit card information.

    In addition, you will need to upload images of the following documents: your picture to create a profile picture, your press identification, and your proof of vaccinations.

    When you create an account, you can provide the following additional optional information: emergency contact information (name, relationship, phone and email).

    Finally, you will create a password that meets the Site’s requirements and agree to this Policy, the Site’s Terms of Use, and the White House Press Corps Travel Policies. You are responsible for maintaining the secrecy of our log-on credentials. Do not share your credentials with anyone.

  • 1.2. Account Log In or Taking Action Within Your Account:

    Each time you log into the Site, we collect your log on credentials and any information regarding your use of our Services once logged in, such as date and time of your particular log in.

    Once logged in, we collect additional information such as your travel preferences (e.g., a request to book a flight, ground transportation, lodging; whether you need a workspace, etc.), add other details that are required by the WHTO. We will also collect information if you change our update any of your account information, including any of your personal information.

  • 1.3. Contacting Us:

    Such as to inquire about Services, report a problem with our Services or to make a request.

  • 1.4. Selecting Travel Arrangements:

    When you use the Site to select options for a trip organized by the WHTO, we collect your travel preferences and needs, based on the options made available by the WHTO for the trip.

  • 1.5. Provide Us with General Information:

    We or the WHTO may ask you to complete a survey or questionnaire or ask for additional information about the Site our Services.

  • 1.6. Sign Up for Communications:

    We collect your name and email address if you opt-in up to receive communications from WHTO about your travel arrangements.

  • 1.7. Your Employer:

    Your employer may provide us with a list of persons authorized to register and become and Authorized User. Your employer may also provide us with your personal information as part of either the Site registration process or as you sign up for WHTO trips. More information about how we use data in conjunction with our Services (defined below) is set forth in the section “Information we Collect as a Service Provider.”

  • 1.8. The White House Travel Office:

    The WHTO will provide us with information such as trip and itinerary details. The system administrators from the WHTO have access to the Site to read, view, download, edit, and manage all trip details including the personal information of any traveler who is participating in a trip. The WHTO may provide us personal information with respect to press credentials, visas, passport information, and other personal information necessary to manage a trip and create a complete trip manifest2.

  • 1.9. White House Correspondents’ Association:

    We may receive personal information from the White House Correspondents Association for the purpose of authorizing users, creating accounts for Authorized Users, and managing users. You can find out more about the White House Correspondents Association at https://whca.press/.

  • 1.10. Travel Suppliers:

    We may receive personal information from a travel supplier (e.g., airline, hotelier, provider of ground transportation) as the WHTO manages trips and creates manifests.

2For the avoidance of doubt, in our policies we use the term “manifest” to mean a document giving comprehensive details of a trip, including detailed personal information, including sensitive or special personal information, of the trip’s participants (travelers). A manifest could also include payment information, depending on the WHTO’s requirements.

We collect information about you automatically when you use the Site and our Services.

We automatically collect certain information about you when you use the Site or our Services. We collect this information through our service providers, which include operating systems and platforms, internet service providers, payment processors, and data analytics providers. The type of information that we collect varies on the settings on your browser, and your interactions with the Site and our Services, and may include: information about your equipment, browsing actions and patterns, such as the date/time you visit/log into our Services, the pages you visit, the length of time on each page, our IP address, device ID, device type, location information (collected, e.g., through our analytics providers). Our service providers also may track your behavior through links that you click on our Sites. See the section below titled “Cookies” for more information. If you are logged into the Site and or using our Services, we may associate certain of this automatically collected information with your account, for example, for trouble-shooting purposes, and to assist us in determining how users use our Services, but we do not typically associate this information with the personal information that we collect about you.

2. How We Use Your Information

We use your information, including personal information, for the following purposes:

  • 2.1. To Provide our Services to you and for related Transactional Purposes:

    For example, to facilitate your access to trips organized by WHTO, including when your information is included in a manifest or other trip details for the WHTO. We will also use your information for billing and invoicing purposes, and to ensure that your profile is accurate and up to date.

  • 2.2. Communicate with You:

    To communicate with you, respond to your inquiries, and for other customer services purposes. This may include contacting you regarding your customer support or other requests. In addition, the WHTO system administrators have the ability to communicate with you through the site to, for example, provide you with updates about a trip details or itinerary.

  • 2.3. Administration:

    For administrative purposes, including to manage access to and security of our Site and Services, and to facilitate proper functioning of the Site and our Services; to help us better understand how users access and use our Site and Services, including the pages viewed, or other Site activity; to maintain security and operability of our Sites (including for debugging purposes); to provide reports to the WHTO, White House Correspondents Association, service providers, regulators, and others; to implement and maintain anti-piracy, fraud prevention, and other services designed to protect you and us; to enforce this Privacy Policy, our Terms of Service, and other policies.

  • 2.4. Legal Compliance:

    To comply with applicable legal or regulatory obligations, including to respond to a subpoena or court order; to cooperate with law enforcement or other governmental investigations; and as part of legal proceedings.

  • 2.5. Protection of us and others:

    Where we believe it is necessary to protect us and others, including, without limitation to detect, prevent, and respond to fraud, security incidents, or other issues where we believe it is appropriate to protect us and others.

3. Disclosure of Your Information

We may disclose your information, including your personal information, as set forth in this Privacy Policy and otherwise as we may notify you from time to time, including:

  • 3.1. The White House Travel Office:

    Your personal information, including special or sensitive personal information, will be disclosed to the WHTO and any contractors or other third parties that the WHTO may engage to, for example, provide services in advance of a trip including on-site preparations.

  • 3.2. Governmental Entities:

    Your personal information, including special or sensitive personal information, will be shared with U.S. and other nations’ governmental agencies for reasons related to participation in trips organized by the WHTO, such as passport, visa, customs, and press credential reasons. In addition, flights are subject to laws, rules, and regulators that require disclosure of the name of all persons on the flight to the operator performing the flight. Additionally, we may be required to furnish passenger information, such as name and date of birth, or passport information, to comply with national and international security requirements.

  • 3.3. To our Affiliates:

    To the extent permitted by law, we will share your information with our affiliates and subsidiaries, so they can provide Services to you and support the Site.

  • 3.4. Travel Suppliers:

    To the extent required by the WHTO, if all or any portion of a trip are provided by commercial travel suppliers (e.g., air transportation, lodging, ground transportation), your personal information including special or sensitive information will be shared with those suppliers.

  • 3.5. Service Providers:

    We provide your information to service providers who assist us in providing the Site and our Services to you. These include entities that host our websites, assists us with the information security associated with the Site and our Services, and assisting with making related travel arrangements as required by the WHTO and related governmental entities.

  • 3.6. Investigations and compliance with legal obligations:

    To assist us with fraud prevention, governmental or other investigations, and as we believe necessary to protect our own rights or the rights, property, or safety of Air Partner, its subsidiaries or affiliates, its employees, customers, or the public; to comply with any court order, law, or legal process, including to respond to any government, law enforcement, or regulatory request. We may do so when (a) permitted or required by law, (b) trying to protect against or prevent actual or potential fraud or unauthorized transactions, (c) investigating fraud which has already taken place, or (d) otherwise cooperating with a governmental investigation.

  • 3.7. Aggregate and de-identified information:

    We may disclose aggregate and de-identified information about Site users to our Service Providers to improve how the Site functions and to evaluate how the Site operates.

We also disclose your information, including your personal information (which includes special or sensitive personal information), in the following circumstances. The recipients will vary based on the basis for the disclosure and include: governmental entities, law enforcement, WHTO, White House Correspondents Association, Air Partner’s affiliates and subsidiaries, advisors, and other entities where such disclosure is required and/or permitted by applicable law:

  • 3.8. To Facilitate Travel Arrangements:

    We will disclose your personal information, including special or sensitive personal information, to the WHTO and travel suppliers, so that you can participate in trips organized and managed by the WHTO.

  • 3.9. To Create a Manifest:

    We will process your personal information, including special or sensitive personal information, to create a manifest.

  • 3.10. Billing and Invoicing:

    We will process your personal information, including payment information, for billing and invoicing purposes. We do not facilitate payment transactions on the Site.

  • 3.11. Our Own Potential Business Transaction:

    In the event of a potential or actual business transaction, and to evaluate such a transaction, including a merger, divestiture, restructuring, reorganization, disclosure of some or all of our assets, dissolution, or other sale or transfer of some or all of our assets, we may share your information with a buyer or potential buyers, legal, tax, and other advisors, and other persons in connection with the transaction.

  • 3.12. Investigations:

    To investigate or comply with legal requirements arising from an actual or threatened cybersecurity incident or any other investigation as we deem appropriate.

  • 3.13. For our Terms of Service:

    To enforce or apply our Terms of Service and other agreements or policies, including for billing and collection purposes.

We do not share personal information that we collect from you with non-affiliated parties for their own direct marketing purposes.

4. Cookies and Other Tracking

We and our service providers use cookies and other tools to track information about your use of the Site. We do not typically associate this information with the personal information that we collect about you, nor do we attempt to identify you as a natural person through this information. 5. Do Not Track

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed above (e.g., by disabling cookies); you also may opt out of targeted advertising by following the instructions above.

6. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. If you do not wish to have your e-mail address and other contact information used by Air Partner for any purpose other than to provide you with Services, you may contact us at whpress@airpartner.com to opt out of receiving ancillary services or promotions, and in some locations, we will not promote out products or services to you unless you have opted in to receiving such services. If we have sent you a promotional e-mail, you may also click on the opt-out link at the bottom of the email and follow the opt out directions. This opt-out does not apply to information that you provide to us as a result of a product or service purchase, program registration, product service experience or other transactions initiated by you. For the avoidance of doubt, you cannot opt-out of receiving certain notices from us if you have booked a flight.

7. Your Rights Under Applicable Privacy Laws

We recognize that under applicable privacy laws, you may have the right to do any of the following:

  • 7.1 Confirm whether we are processing and accessing your personal data.
  • 7.2 Correct inaccuracies in your personal data.
  • 7.3 Request deletion of your data (whether the personal data was provided by you or obtained by another source).
  • 7.4 Obtain a portable copy of your personal data.
  • 7.5 Elect out of processing for the purposes of targeted advertising, sale of personal data, or profiling.
  • 7.6 Appeal our refusal to act on your request to exercise your rights under applicable privacy laws.

8. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Unfortunately, the transmission of information via the internet and mobile devices is not completely secure and we cannot guarantee the security of your personal information transmitted to or through the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

The safety and security of your information also depends on you. You are responsible for keeping your password(s) confidential. We ask you not to share your password with anyone.

9. Children’s Personal Information

The Site and our Services are not intended for children under 16. We do not knowingly collect or solicit personal information directly from children or knowingly allow such persons to register. The Site contains links to websites or applications that we do not control or maintain, such as when the WHTO enters a trip description, and the description includes links to a travel supplier’s website. If you are directed to a third-party website through a link, we are not responsible for the privacy practices of any such website. If you follow a link from the Services to another website or application, that website or application's privacy policies will govern any information that website or application collects about you.

11. Additional Information for Non-U.S. Users of our Services

The Site his hosted by our service provider in the United States. Information that we obtain from or about you in connection with your use of the Site and our Services, will be collected, processed, stored, disclosed and disposed of in the United States, which may not be deemed to have the same level of protection as your home country. If you are a user outside of the United States you acknowledge and agree that we may collect and use your information as discussed in this Privacy Policy, outside your resident jurisdiction.

In certain jurisdictions, you may have the following additional rights, and we have obligations, with respect to your personal information.   • 12.2. Legal Basis of Processing

    We collect your information as a data controller when we have a legal basis to do so. The following legal bases pertain to our collection of data:

      Our use of your personal information is in our legitimate interest as a commercial organization (for example in order to make improvements to our products and services and to provide you with information you request); you have a right to object to processing as explained in the Legal Rights of EEA/UK Users section below;

      4. Administration (legitimate interests in ensuring the security and proper functionality of our platform, in understanding how our Site is used, in improving our Site and Services, and in ensuring that our policies and Terms of Service are complied with);
      5. Research and development/Analytical purposes (legitimate interest in improving our Services, products and customer experience and in understanding how and by whom the Site is used);
      6. Protection of us and others (legitimate interest in establishing, exercising and defending against legal claims and safeguarding our and others’ rights and safety);

    We retain your personal information for as long as necessary to provide our services to you, to fulfill the purposes described in this policy and/or our business purposes, or as required by law or regulation.

    Exceptionally, we may store personal data longer, should this be necessary for the establishment, exercise or defense of legal claims. In such case, the processing of affected personal data will be limited to said purpose.
